Things you need to know about your place of work

In the past few years different employment arrangements have become common in the so called ‘Gig Economy’ with practices such as zero-hours contracts.

As such the word ‘Employer’ is being redefined. Yet, however you are employed, the person or business you work for still owes you a duty of care in taking reasonable and practicable steps to protect you from risk of injury. This is the same whether you work payroll under PAYE, or are self -employed or a contractor. The ‘employer’ is the person that controls what you do, where you go, and what you are paid.

Employers are also required to provide you with a safe place in which to work and to supply competent work colleagues. If you are injured due to a careless employee, or unsafe working conditions, you should be entitled to compensation for your injury and consequential losses.

If carrying out work involves the possibility of injury, the employer should carry out a risk assessment and identify the risk of injury. Then take all reasonable steps to prevent it.

Instances where this may be most relevant are Manual handling operations or Working at Height.  Here it is likely that health and safety regulations will apply, or that guidance has been published for employers to follow. If guidance is ignored accidents can happen and the employer will most likely be liable.

Guidance also normally applies to Lifting operations, Electricity at work and Control of Dangerous substances, and many other specific work-related activities
